The following are terms and conditions for the sale and or hire of goods that will govern any contract for sale or hire that we enter into with you the consumer. Please read these terms and conditions carefully.
These Terms and Conditions tell you the rights and obligations you have. You may have other rights granted by law and these Terms and Conditions do not affect them. This does not affect your statutory rights as a consumer.
We would advise you to print these terms & conditions of sale for your own reference, as they form part of the contract for the sale of goods between Burnside Kilt hire company Ltd. and you the consumer.

Purchasing from us
To purchase from us you must be over 18 years of age. Currently, we can only ship to limited countries (please check countries on checkout of web site). By submitting your order you are offering to buy the goods at prices and terms as stated, and allowing us to use your personal details for the purposes of supplying goods (including passing your details onto couriers and other subcontractors). We will not use your details for other purposes without asking your consent and you may ask that your details are removed from our system by writing to the address above. We are not obliged to supply the goods to you until we have confirmed acceptance of your order - Your order is deemed accepted when you receive a confirmation for despatch of goods, this is when the contract is made. You do not own the goods until we receive payment in full. If you discover you have made a mistake with your order please contact us immediately. Please do this before we confirm your order.
Hiring from us
COLLECTING A HIRE FROM A BURNSIDE SHOP:
You ("the hirer") must pick up your hire on the stated collection date (unless otherwise agreed on the terms of hire) and try on the hire garments to ensure a correct fit. Should the garments be unsatisfactory this must be reported to Burnside immediately or by 10.30am on the morning following the collection date.
Burnside will not accept any responsibility for unsatisfactory garments if you to make us aware within the specified timeframe
Burnside makes every effort to have your hire garments ready for collection on the stated pick up date, however your hire is deemed to begin at 9.00am on the function date unless otherwise expressly noted in writing.
PROOF OF IDENTIFICATION:
When you or we arrive to collect your hire, you must supply two forms of identification in order to collect the hire. Suitable forms of identification are as follow: Current Passport or Driving Licence and a Utility Bill or Council Tax bill that shows your current name and address.
Failure to do this will result in Burnside withholding the hire until suitable identification has been shown.
CHANGES AND CANCELLATION:
Changes to any hire orders must be made no later than 1 weeks before the function date for which any additional costs will be payable by the hirer. Should you need to cancel your order you must inform Burnside immediately. Deposits are non-returnable.
Please note - you will be held liable for any non-returned items including hangers and carrier supplied when you return your hire, which you will be charged for at full replacement value.
A £10 per day charge will be made on late returns.
ACCIDENTAL DAMAGE WAIVER:
The Accidental Damage Waiver covers hire garments up to the value of £200. Loss or malicious damage is not covered and charges will be made accordingly. Underwear must be worn with the kilt, as the damage waiver will not apply to kilts that are returned soiled, where a £20 charge will be levied. You are expected to treat the hire garments with care. Deposits are not returnable on uncollected hires.
RECEIVING AN ON-LINE HIRE FROM BURNSIDE:
You ("the hirer") will receive your hire on the stated delivery day/date and try on the hire garments to ensure a correct fit. Should the garments be unsatisfactory this must be reported to Burnside immediately or by 10.30am on the morning following the collection date. If the measurements that you have supplied online are found to be incorrect then any costs incurred in ectifying the order shall be lvied against the hirer.
Burnside will not accept any responsibility for ill fitting garments where Burnside kilt company have provided those garments to the customers specifications.
Burnside makes every effort to have your hire garments delivered on the stated delivery day/date, however your hire is deemed to begin at 9.00am on the function date.
PROOF OF IDENTIFICATION:
After you have ordered your hire outfit on-line, Your online hire can the be picked up or delivered to the address used in the customers account setup.
Please note that garments will only be released on satifactory proof of Identification. Suitable forms of identification are as follow: Current Passport, Driving Licence and a Utility Bill that shows your current name and address.
Failure to do this will hold up your order being processed until suitable identification has been faxed or sent.

YOUR HIRE DELIVERY AND COLLECTION BY OUR COURIER
You have to make sure that someone is available to receive and return your hire to our courier at the agreed time and date. Failure to do so will result in further charges being levied to your credit card automatically.
You are expected to treat the hire garments with care.
Deposits are not returnable on uncollected hires.

Product Conditions
New
Items will be new and will have the Original Manufacturers full warranty.
As New
Items will be in as new condition, but may have been returned to the Original Manufacturer as a failed or incorrect delivery. These items would then be fully tested and reboxed if needed by the Manufacturer and sold "As New" with the Original Manufacturers full warranty or covered by Burnside Kilt hire company Ltd. warranty which will be stated in the product description.
Used
Items will be used, but will have been thoroughly cleaned and tested by ourselves. They may have minor cosmetic scuffs or marks but will be in full working order, Used Items typically carry a 30 or 90 Day Return to Base Warranty from ourselves.
Prices and Payment
All goods are priced inclusive of VAT at the Applicable Rate, unless otherwise stated. For out of stock items, delivery dates given are only estimates. Prices are shown in UK pounds sterling and will be billed in UK pounds sterling. If your credit card company operate in a different currency, your credit card company will convert payment from UK pounds sterling to your local currency at their current conversion rate.
All prices and offers are subject to change, and availability. Prices are checked regularly, however, whilst every effort is made to eliminate errors in pricing, sometime errors do occur. If prices on web site are shown higher than actual selling price - we will make adjustments and charge the correct price to you, if prices on the web site are shown lower than actual selling price - than we will at our discretion either. a) contact you, cancel your order and refund your money, or b) contact you to confirm if you wish to proceed with the order at the correct price. - Subject to not selling below our cost price.
The purchaser is liable for any additional local state, country taxes, import duties or copyright levies, should these arise.
Credit Card Security
Once you have gone through our checkout, you will be diverted to our protected secure online payment system with our credit card processor, RBS World pay Services. Your credit card information will be held in protected SSL secure servers, at RBS World pay Services, we will not have access to your full credit card details, and we will not release information regarding your credit card. Your credit card details will only be used for transaction authorised by you.
We currently only accept VISA, MasterCard, VISA Delta, Switch and Switch Solo.
(IMPORTANT NOTE: customers using Switch should supply a "Start/Issue Date" and an "Issue Number" for the card where applicable, as well as card number and expiry date.)
Cooling-Off Period
By law you have the right to cancel any order within 7 working days of the day after the item is delivered to you. To cancel an order you need to write to us at :

or use our contact form and inform us in advance of you wish to exercise your right to cancel your order, we will issue a goods return reference number and return the item to us. We will refund the orginal amount paid. All we ask is please take care of our goods, ensure all items are complete are in their original packaging, unused and in resalable condition. For your protection, please send items back well packaged and using a recorded delivery service.
If you do not return the goods within 21 days of cancellation we will collect the goods from you at your cost and will deduct the cost of collection from your refund, or if requested we will arrange collection of items at your cost.
All monies paid for cancelled goods will be refunded within 30 days from date of cancellation.
Please note: It is a legal requirement that you take care of the goods and you are responsible for the carriage costs of returning goods to us unless we delivered goods to you in error, or if goods are faulty.
